Nice color, but sizing off by 2 sizes

Size is way off, by about 6". I am a Medium size 32" waist. I did not even try them on as the waist band of the Medium was 25" unstretched, smaller than their size listed for a small. There is a no return policy, yet I would call a sizing off by 6" as defective.
